Sherry Flax concentrates her practice on matters dealing with intellectual property law, with an emphasis on trademarks and copyrights.
She assists clients in all aspects of securing and protecting their rights in commercially valuable property through U.S. and international trademarks and copyrights, domain names, trade secrets, and licensing. She regularly counsels clients on the use and protection of intellectual property on the Internet and related aspects of business law. She has extensive experience in working with both mature and emerging companies on developing and strengthening brands in a wide variety of industries.
Sherry has more than 20 years of experience in complex civil litigation, including litigating patent, trademark and trade dress infringement, unfair competition, and domain name cases and disputes. She regularly advises clients on litigation strategy and protective measures. Her trademark litigation matters have included infringement cases in the federal courts as well as opposition, cancellation, and concurrent use administrative proceedings before the Trademark Trial and Appeal Board.
Sherry regularly lectures at seminars and other forums on trademark and copyright law and has published several articles on these topics.

- Digital Millennium Copyright Act circumvention, takedown, reverse takedown and anti-cybersquatting claims in federal court and domain name dispute proceedings under the UDRP.
- Consulting and opinions on copyrights concerning derivative and collective works, protection of unpublished works, and “works made for hire.”
- Counseling and litigation in computer law matters including software copyright, anti-circumvention, open source software, computer fraud and abuse, computer theft and hacking, and digital trespass.
- Drafting and negotiating software development and Enterprise Resource Planning (ERP) licensing and implementation contracts.
- Developing and implementing open source software strategies for ERP software vendors.
- ERP Software litigation.
- Trade secret counseling, confidentiality agreements, and litigation with former employees and competitors.
- Trade secret litigation involving confidential and proprietary information and anti-competitive practices, corporate theft and espionage, unfair and deceptive trade practices and similar cases in state and federal court.
- Protection of trade dress and product configurations and enforcement
- Antitrust counseling and litigation concerning unfair competition, monopolies, and other matters related to intellectual property law.
- Regulatory reviews of advertising and promotional materials for conformance with the FTC Act and state Little FTC Acts.
